Gurvinder Khurana, a Delhi-based man, has been ordered to pay Rs 1.78 crore to Mercedes-Benz India after his car was found to have a manufacturing defect. Gurvinder Khurana, Director of Samran Media Consultants Private Limited, had purchased a Mercedes-Benz EQS580 car for Rs 1.55 crore in November 2022.
According to the report of Indian Express, it was a luxury car, but after just six months, many problems started in it. Delhi State Consumer Disputes Redressal Commission gave its verdict in this case and asked the company to pay huge compensation.
Manufacturing defect in car
Gurvinder told that the car started having problems after traveling only 9,000 kilometers. There were many problems like bulge in the rear tyre, sudden stop of the car, radar sensor failure, sensor malfunction and strange noise from the AC blower. These problems were not resolved even after taking it to the workshop several times. The commission observed that these problems began within six months of purchase and persisted to this day, despite repeated attempts by the company to fix them.
The commission rejected the arguments
Fine of so many crores of rupees imposed
The compensation included the cost of the car Rs 1.55 crore, insurance and road tax Rs 3.1 lakh, tax collected at source Rs 1.55 lakh and interest on loan of Rs 1 crore for 60 months Rs 16 lakh. Apart from this, the company was asked to pay Rs 5 lakh for mental distress and Rs 50,000 for litigation expenses. Overall the compensation amounts to Rs 1.78 crore.
What can you do if an expensive car breaks down?
This case is a lesson for those who buy expensive cars. Even after paying this much price, if there is a problem with the car, the consumer court can help you. Even a big company like Mercedes has to follow the rules. If you are also thinking of buying a luxury car, or you have a luxury car and it breaks down within a few months, then first of all document the problem of the car properly. Every time you visit a service center, keep a record of the repair details, date, and what was repaired.
If the problem is recurring, then note it in writing. Then, complain to the company in writing. Send an email or registered letter to the dealer and manufacturer detailing the problems and service history. Ask clearly whether they will fix, replace or refund the car. Wait for the reply and keep that also on record.
If the company does not give a satisfactory reply, then file a complaint in the consumer court. You can file a case in Delhi, District or State Consumer Forum. In the complaint, you can demand compensation for the cost of the vehicle, insurance, tax, loan interest, and mental distress.
