Koderma: Due to low budget, people often buy second hand two-wheeler or four-wheeler. However, due to the lure of cheap price, many times buyers ignore the necessary legal and technical checks. Due to which they have to suffer the consequences later. Defense Council Advocate Arun Kumar Ojha of Koderma District Legal Services Authority has shared important information regarding legal precautions to be taken while buying a second hand vehicle.
Buying a car without no objection certificate can cause problems
Advocate Arun Kumar Ojha said that before buying any second hand vehicle, it is very important to thoroughly check the validity of its insurance, registration certificate and registration. Many times the insurance of the vehicle has expired or the documents are not updated, which can lead to huge financial losses in the event of an accident.
He told that if the vehicle has been taken on loan from a bank or any finance company, then it is mandatory to obtain a no objection certificate from the concerned institution. Buying a vehicle without NOC can lead to legal disputes in future. In case of outstanding amount to the bank, the vehicle can also be confiscated. Due to which the buyer may have to face a lot of trouble.
Problems may increase if vehicle is handed over before name transfer.
He told that the vehicle seller should also be careful. Even after receiving the full amount, the vehicle should not be handed over until the name transfer process is completed. If the transfer of ownership of the vehicle is not done and unfortunately in the meantime an accident or criminal incident occurs with the vehicle, then the legal responsibility is assumed to be that of the person registered on the vehicle. He said that if the buyer has taken the vehicle but the name transfer process is pending and during this time an accident occurs, then in many cases there is difficulty in getting the insurance claim.
Get internal inspection done by an experienced mechanic
He advised that if possible, take an experienced mechanic with you while buying a second hand vehicle. Be sure to check the vehicle’s engine, internal systems, meter reading, chassis number, engine number and the actual color of the vehicle. Many times meter tampering or irregularities in documents also come to light. He said that do not make any kind of deal in haste, especially when the seller is exerting extreme pressure. Buying a vehicle without completing the thorough inspection and paperwork can cause major problems in the future. He said that one should not buy a bank financed vehicle without NOC. With a little caution and legal knowledge, buyers can save themselves from a lot of trouble. Vigilance is the best protection when buying a second hand vehicle.
